Miranda Rights
Miranda Rights:
“You have the right to remain silent, anything you say or do can and will be used against you in a court of law. You have the right to an attorney, if you cannot afford one, one will be appointed to you by the state if available. Do you understand these right as I have read them to you today? And with these rights in mind do you still wish to speak to me?”
You MUST read them their rights after being placed under arrest, if you wish to use their statements and actions against them in a court of law. If you do not read a suspect their rights whilst under arrest and conduct questioning none of the information given can be used in a court of law as it is inadmissible due to their rights not being protected. Any information given up with free will can be used. You must NEVER mirandarise a group of people at once, you must read everyone their rights separately and individually. IF a person is downed / unconscious you MUST wait until they are treated so that they can fully comprehend their rights as conversation and questioning should not be occurring while an individual is downed. If a suspect tells you they want a lawyer or attorney you MUST stop all questioning at the moment they request one, you may only ask if they require Food, Drink or Medical attention, and do everything you can to obtain legal counsel for them. You MUST not at any time attempt to coerce or convince a suspect to work with you or talk them out of getting an attorney / working with you on charges.
